Above all, our goal with these terms and conditions is:
- that you are clearly informed of the terms of sale (we love transparency).
- to comply with the law.
- that you are satisfied with your purchase.
Article 1 - Scope of application
These terms of sale apply to all transactions made through the site: sekhem-digital.com and ALL subdomains attached to it. They are intended to govern all rights and obligations of the parties in the context of any operations carried out on sekhem-digital.com. These sites are the exclusive property of Lassina Sougrinooma Sawadogo, whose registered office is based in London.
No specific condition, at the client's initiative, may be added to or substituted for these terms and conditions. The fact that sekhem-digital.com does not invoke a breach by the client of any of the obligations contained herein shall not be interpreted as a waiver of the obligation in question for the future.
These terms of sale apply to all products and services marketed by this site.
A "client" is any individual or legal entity placing an order with this site that has been validated via our secure payment platform, or by cheque or cash.
Article 2 - Subject of the contract
By visiting "sekhem-digital.com" (hereinafter the sekhem-digital.com website or any other subdomain of the same site) or by purchasing the products and/or services offered there, you agree that you have read, understood, and accepted these terms of sale (hereinafter "Terms") in their entirety, and to comply with them fully. The client acknowledges having read these Terms of Sale prior to any use and/or subscription to any products and/or services on sekhem-digital.com.
Consequently, any use and/or subscription to any products and/or services on sekhem-digital.com implies full acceptance of these Terms of Sale and of any specific conditions applicable to each product presented on the site.
You understand and agree that, in the event of disagreement, the terms of these Terms of Sale shall prevail over any oral or written communication established between you and any representative of this site.
These Terms may be amended, so you are invited to consult them regularly. Lassina Sougrinooma Sawadogo, owner of this site, cannot be held liable for content errors, viruses, or any other element that could damage the integrity of your computer equipment, nor for any consequences of a security breach of its PayPal™ or Stripe payment systems. You alone assume the risks related to the use of this site and of all sites whose links appear on sekhem-digital.com.
Article 3 - Use of content
You understand and agree that the products and services offered by this site must not be used for illegal purposes. By accepting the terms of sale, you certify the non-liability of the company, the site, its partners, and its representatives in the event of inappropriate use of the products and services, as well as any direct or indirect consequence of your actions.
The client is solely responsible for their use of the services offered by sekhem-digital.com, and the liability of the company, its manager and/or partners, its staff and/or any other person involved in any service offered on sekhem-digital.com is excluded accordingly.
Article 4 - Intellectual property
You understand and agree that any use, reproduction, resale, or simple communication, written or oral, of the products, services, and content offered by this site (for example, but not limited to: reuse of training content for purposes other than your own professional use) is strictly prohibited without the written consent of this site and its representatives, and will systematically be subject to legal action.
You understand and agree that, when you send this site a written or oral testimonial about one of its products or services, it becomes the property of the site, which implies the assignment of the right of reproduction, editing, and publication. Unless you request otherwise in writing, this publication may mention your first name, as well as your profession and place of residence.
You understand and agree to the following conditions, which govern all refund requests without exception for all services and products published by Lassina Sougrinooma Sawadogo on sekhem-digital.com or any other subdomain of the same site.
Article 5 - Order placement procedures
Any order placed on this site implies full and unreserved acceptance of these terms of sale, which have contractual value. Once your order has been entered on the site, a confirmation email will be sent to you and your order will be registered. Upon receipt of this order, you will receive the information necessary to access the product.
Orders on sekhem-digital.com are placed via an online payment form on sekhem-digital.com.
Payment for the order is made via Stripe, or any other secure online payment platform offering equivalent guarantees, and therefore requires the client to have a valid email address for sending and receiving. Otherwise, they will not be able to receive written confirmation of their order. Contractual information will be presented in English.
The order placement procedure on the sekhem-digital.com website comprises the following steps:
- The client selects the product they wish to order.
- The client is then redirected to the order form integrating the secure Stripe and/or PayPal payment platform, where a summary of the order will be presented, including the chosen service, the total price, their details, the delivery method, and the payment method.
- Pursuant to the provisions of Articles 1316-1 et seq. of the French Civil Code, any order form signed by the consumer via "double click" constitutes an irrevocable acceptance that can only be challenged in the cases provided for in these Terms of Sale.
- The "double click" associated with the order placement procedure described above constitutes an electronic signature. This electronic signature has, between the parties, the value of a handwritten signature, within the meaning of Articles 1316-3 and 1316-4 of the French Civil Code.
- The order will be registered when the client validates the various details on the Stripe, PayPal, or any other payment site offering the same security guarantees.
- The contract will be definitively concluded once payment has been accepted by the client's bank.
- The date and time the contract takes effect is when payment is accepted by the client's bank.
- After final validation of the order, a confirmation email summarising all elements relating to it will be sent to the client.
Article 6 - Price
The prices of products sold via the sekhem-digital.com website are indicated in Euros, inclusive of all taxes (VAT + any other taxes, where applicable), and correspond to those in effect on the day of the order on the product description pages. Prices may be changed at any time. However, the rate applied to an order will be the one announced at the time of the order. Telecommunication costs necessary to access the Company's websites are the Client's responsibility.
Article 7 - Products and services
In accordance with the provisions of Articles L. 111-1 and L. 111-3 of the French Consumer Code, the essential characteristics of the goods and services and their respective prices have been made available to the buyer on Lassina Sougrinooma Sawadogo's websites. Most training is delivered via an online training platform or online content. In this context, Lassina Sougrinooma Sawadogo provides the client with access to this platform, allowing them to follow their training course. Access to this platform may be time-limited (depending on the product chosen). The right of access to this platform is personal, unique, non-transferable, and non-assignable, and is granted by means of an access code that may not be shared, assigned, resold, or retransmitted; the platform is open 24/7, except in the event of technical faults or scheduled updates.
In the event of a breach of the rules relating to access codes, and in particular in the event of use of these codes by several people, Lassina Sougrinooma Sawadogo reserves the right to remove the service immediately, without compensation, notice, or prior information.
It is essential that the Client has adequate computer equipment enabling them to follow the training (computer, screen, internet connection, web browser, email software, sound card and speakers to hear the videos; in most cases, a laptop-type device is sufficient). The client also acknowledges having received all the information required under Articles L. 121-8 and L. 121-19 of the French Consumer Code, as well as the terms of payment, delivery, and performance of the contract.
The Seller undertakes to honour the Client's order only within the limits of available Product stock. Failing this, the Seller shall inform the Client.
This contractual information is presented in detail and in English. In accordance with French law, it is summarised and confirmed when the order is validated. The parties agree that illustrations or photos of the products offered for sale have no contractual value.
The validity period of the Products' offer as well as their prices is specified on Lassina Sougrinooma Sawadogo's websites, as is the minimum duration of contracts proposed where these relate to a continuous or periodic supply of products or services.
Unless otherwise specified, the rights granted herein are granted solely to the individual signing the order (or the holder of the email address in the case of a company).
It should be noted that the results achievable through the training products are naturally dependent on the correct application of the advice given. The successful outcome of the methods presented and taught depends in part on the user's commitment to assimilating the techniques given and practising them so that they produce the expected results.
Article 8 - Payment
Payment is due immediately on the date of the order. Payments are made by credit card, PayPal, or Stripe. The client is subject to the terms of use of PayPal or Stripe. Information transmitted is encrypted and cannot be read during transport on the network. Any guarantee as to the security of this system is entirely the responsibility of the bank and cannot be attributed to us.
Article 9 - Terms of performance and delivery of the order
Delivery is made to the email address you provided when placing your order (therefore, please pay particular attention to the spelling of the address you enter), or to your postal address (for any physical product ordered — so please be careful to provide accurate details), as well as on certain thank-you or confirmation pages sometimes accessible directly after payment.
Consequently, the company cannot be held liable for errors made in entering the email or postal address of the client when placing the order.
In accordance with current legal provisions, sekhem-digital.com guarantees the client against any defects in conformity of the services and products delivered.
In the event of a defect in conformity or malfunction of any of these products or services, the client must submit any complaint by email, to contact@sekhem-digital.com, no later than the second business day following the order.
Any complaint submitted after this deadline and/or not made in accordance with the terms defined above will be rejected without recourse and releases sekhem-digital.com from any liability towards the client.
Article 10 - Access terms
After purchase, an access code and password are sent to each client so that they can have a reserved space allowing them to download or use the digital products. These are personal, confidential, and non-transferable.
Article 11 - Cancellation, return, and refund terms
Our priority is customer satisfaction.
In accordance with Articles L.120-20 et seq. of the French Consumer Code, you have a period of (fifteen) 15 days to exercise your right of withdrawal without having to justify your reasons or pay any penalties, except, where applicable, return costs. The fifteen-day period runs from the date the items are received.
If you are not satisfied with your purchase, you have 15 clear days from receipt of your order to request cancellation and a refund. You must make this request by registered letter with acknowledgement of receipt to the seller's address, providing all the information necessary to process your request (including your name, order number, and email address).
Exception: No refund will be made after the product has been ordered in the case of a digital product already downloaded. This withdrawal period does not apply to digital content supplied on a non-material medium, or to a subscription contract for such services whose performance has begun with your agreement and for which you have waived your right of withdrawal (example: seminar replay, etc.).
Also excluded from any possibility of refund are: conferences, seminars, as well as any event or product that does not explicitly bear, in the description made of it on the site, the mention "satisfaction guaranteed or your money back".
A refund of the service, product, or service ordered is only possible if such an option is mentioned on the sales page for the service, product, or service concerned and under the conditions specified there.
Subject to the client complying with these formalities, the refund will be made within 6 days.
Article 12 - Client's personal information
The various information requested from the client when placing their order is necessary to process it and may be communicated to the company's various contractual partners (accountants, lawyers, etc.), as well as to any competent authority, in the context of any dispute that may arise during the course of the contractual relationship between the parties.
Computerised records, kept on the servers of sekhem-digital.com, as well as on the servers of its banking institutions, are carried out on a reliable and secure server.
Article 13 - Applicable law
All clauses contained in these terms of sale, as well as all purchase and sale transactions referred to therein, shall be subject to French law.
Article 14 - Liability
The client is solely responsible for the consultation, choice, use, and interpretation of the documentation provided.
Our liability cannot be invoked, either towards third parties or the client, for the consequences of the client's use of the results of searches, or omissions following an unsuccessful, defective, partial, or erroneous search, or the misuse of the answers and text consulted.
Consequently, we cannot be held, under any express or implied obligation, civilly liable towards the client or third parties for any direct or indirect damage arising from the use of the information, and in particular resulting from inaccurate or incomplete information, an indexing error, or a delay in publication online.
Article 15 - Information about the company
